January 13, 2012 (by Horatio Algren) According to reports a woman was injured when struck by a vehicle in a crosswalk near an elementary school.

According to Fullerton Police Lt. John Siko, the woman was struck in the crosswalk, at approximately 8:20 a.m. in the crosswalk at Richman Avenue and Baker Avenue in Fullerton. The crosswalk is located adjacent to the Woodcrest Elementary School, Lt. Siko said.

The woman was lying in the crosswalk in front of a Honda Civic, when officers arrived on the scene.

According to Lt. Siko the woman was transported to St. Jude Medical Center and the investigation is continuing into the accident to determine how it occurred.
Lt. Siko said did not know the details of the woman’s injuries.

January 6, 2012 - According to reports a wrongful death lawsuit has been filed by the parents of a child that choked to death on a pushpin at school.

According to Danny Howell a wrongful death lawsuit was filed on Thursday naming the North County Oceanside Montessori School in San Diego, in the choking death of 3 year old Tyler Howell.

The three year old was attending the school in October when he choked to death after swallowing a pushpin.

Danny Howell stated that the state discovered a variety of violations at the school, including allowing their son to use the bathroom alone. This is where three year old Tyler found the pushpin, according to family members. Another of the violations was allowing hazardous objects to be where a child could reach them, which is where the pushpin was located.

According to family attorney David Casey items like pushpins are required to be stored properly. Casey went on to state that objects that could cause death to a small child should not be around them.

Danny Howell stated that the violations are what led to the death of his son. The father stated that he, his wife and two and a half year old daughter are taking things one day at a time and that their daughter cries calling out Tyler’s name.

Howell said that he doesn’t know how something good can come from this tragedy, but if they can help other parents, sisters and brothers from going through this, their son’s death won’t be in vain.

According to the Los Angeles Police Department at Topanga Division, Martin Weiss age 47 was arrested on Tuesday on suspicion of molesting one of his child star clients. According to Los Angeles Police Department coordinator for the sexual assault unit, Detective John Alviani, stated that Weiss was arrested on suspicion of committing lewd acts on a child under the age of 14, Tuesday.

Weiss was arrested in Santa Monica, where he lives and has is business, where detectives executed search warrants. According to the alleged victim, who was an aspiring musician and singer was allegedly sexually assaulted in Weiss’s apartment in Santa Monica and also in a Woodland Hills home.

Weiss was held at the Men’s Central Jail and Det. Alviani stated that police attempted to have the standard bail tripled due to the multiple counts in the alleged compliant.
Weiss’ bail was set at $300,000 by Superior Court Judge Melvin Sandvig. In court documents that were filed in Los Angeles the former client of Weiss went to police on November 17th to report the molestation that he suffered from the age of 11 or 12 years old, until he turned 15.

November 14, 2011 - According to reports a Whittier man died after coming in contact with a downed power line.

According to police the man that died was a 24 year old that lived in the 8100 block of Friends Avenue and has been identified Joel Ramirez.

He was found lying on the ground and officials found a power line that had fallen and caught the home on fire.

October 9, 2011 - According to reports a woman was struck and killed after saving her child from being hit by the train. According to the Riverside Coroner’s Office the woman was identified as 33 year old Susan Dibene.

According to Riverside Police Lt. Jaybee Brennan the accident occurred at approximately 6:58 p.m. on Saturday when the woman was pushing her daughter in a stroller south on Mary Street.

Lt. Brennan stated that the safety arms came down, signaling a train was approaching and Dibene attempted to cross the tracks ahead of the train to Indiana Avenue. A wheel of the stroller became caught and the mother was able to get the wheel free and push the stroller to safety.

Anthony Bertagna a 33 year old man was struck and killed in the 100 block of South Newhope Street in the vicinity of First Street at approximately 12:30 a.m.

According to GM stated there can be a , kink, bend or fold in the front passenger presence sensor. When the airbag becomes disabled the status indicator on the rear view mirror will show the airbag is off, the airbag indicator will be illuminated and the service airbag message will appear.

According to California Highway Patrol Police and Buena Park Police Sgt. Brad Geyer, the two Buena Park Police officers were involved in a rear end crash that occurred at approximately 3:09 a.m. Sunday.

Teen Injured in School Wood Shop Case Goes to Court

Ten People Injured in Knott's Berry Coaster Accident

October 8, 2010-According to reports at least ten people were injured in a Knotts Berry rollercoaster mishap in Orange County.

According to officials ten people were hospitalized after a roller coaster accident at the Southern California park.

The rollercoaster at the Knott’s Berry Farm known as the Pony Express had two cars that collided.

According to officials one of the cars rolled back from the boarding station into another car that people were getting on.

Capt. Greg McKeown of the fire department stated that the injuries were minor and the injured victims were transported to the hospital.

Knott’s Berry Farm spokeswoman Jennifer Blazey stated the train leaving the station did not make it over the first hill and rolled back into the other car. There was one person getting into a waiting train car that was injured and nine people that were in the train car that rolled back that were injured.

According to authorities the cause of the accident remains under investigation.

August 12, 2010-According to reports the San Gabriel man that was charged in the drunk driving crash that killed Angels pitcher Nick Adenhart claims he did not intend to get behind the wheel.

According to Andrew Thomas Gallo’s attorney Jaqueline Goodman in a motion to dismiss claims stems from the fact that Gallow had a designated driver the day of the crash, but ended up driving have his step brother that was his designated driver got drunk on beer and tequila. The pair went to two bars and in the 12 page motion to dismiss the grand jury indictment charging Gallow with three counts of second degree murder. According to police, Gallo’s blood alcohol level was almost three times over the legal limit.

The charges stem from the April 2009 crash that killed Angels pitcher Nic Adenhart and two other people, resulting in three counts of second degree murder. His attorney states he did not possess the intended malice, since he did not plan to get behind the wheel and had a designated driver. The crash killed Nick Adenhart age 22, Courtney Stewart age 20 and Henry Pearson age 25. Jon Wihite age 24 also a passenger in the Mitsubishi Eclipse Stewart was driving was seriously injured in the crash.

Susan Price Deputy District attorney accused the 22 year old under the implied malice, since he knew driving under the influence was dangerous to other people. Price also stated Gallo chose to drive and has had a prior driving under the influence conviction. She stated it did not matter whether he planned to drive or not, he did get behind the wheel, running a red light that resulted in the death of three people at a Fullerton intersection.

Price stated Gallo admitted after the crash, when he found out three people had died that he should have called a girlfriend to pick them up. Price said this shows that Gallo knew he should not be driving under the influence and he knew he was wrong.

If Gallo is convicted of the three counts of second degree murder he can be sentenced up to 50 years in prison, without parole. If convicted of three counts of manslaughter he could face 15 years in prison with parole possible after approximately 12 years.

LA Building Explosion Kills Two

July 30, 2010 (by Horatio Algren) According to reports by Los Angeles burn and explosion attorneys, an LA building explosion killed two people after a tampered gas line exploded, Friday.

The Industrial building with a tampered gas line exploded killing one man that was thrown into the street and another person that was electrocuted by a downed power line. Fire Captain Stephen Ruda stated one of the victims was electrocuted when he tried to move his stake bed truck away from the building by a downed power line carrying 34,500 volts.

According to reports the wood front of the South Los Angeles building was turned into shattered wood and beams. Fire spokesman Erik Scott after the explosion the building caught fire and it took 100 firefighters approximately 25 minutes to douse the blaze.

One 27 year old man identified as Daniel Ibarra who works in the building stated he was taking the trash out at the time of the blast. Ibarra appeared to be in shock, had singed hair and had a bruised leg, he stated he was very lucky.

The urban search and rescue team secured the building and sent dogs in to search for one person they had heard reports might be trapped. The dogs according to Ruda did not detect anything and heavy equipment would be brought in to continue the search.
The explosion is expected to have been caused by a natural or industrial gas leak and is still under investigation that ignited when work began.

According to Denise King spokeswoman for Southern California Gas Co. the gas meter at the building was shut off Thursday and there was an illegal line instatlled to the meter that allowed natural gas from a street line to enter the building under high pressure.

King stated the illegal gas line bypassed the meter shut off valve and regulator that is designed to reduce the pressure. King did not know why the meter had been shut off to the building.

The business located at the site of the explosion makes metal security gates, windows, doors and security fences and has four employees, according to secretary Elizabeth Alvarado. Alvarado was not at the building when the blast occurred and stated that the business owner Jaime Lara arrived every morning and started the propane furnace. This furnace is used to heat cure the paint on the metal.

A welder identified as Johnathan Apol age 20 that works in the next building heard the blast and went to the street where two men were standing dazed and one was shouting Jamie.

The blast from the explosion and fire caused the building to collapse and debris from the explosion was thrown along the block. The explosion also shattered some vehicle windows in the area.

Weekend Deadly for Two California Highway Patrol Officers

June 28, 2010-According to reports the weekend was deadly for two California Highway Patrol Officers. The first deadly accident occurred on Sunday morning near Barstow, when the California Highway Patrol officer was making a traffic stop. The officer identified as Justin McGrory was struck by a vehicle that veered over to the side where McGrory had a vehicle pulled over for a traffic stop for speeding in the vicinity of Hodge Road.

The officer was standing outside of the vehicle when he was struck by Rafael Garcia age 18 of Las Vegas. Garcia was arrested for suspicion of vehicular manslaughter and could face additional charges after the results of toxicology test are received.

According to California Highway Patrol officer Mario Lopez stated Garcia was remorseful at the scene of the accident and was cooperative with investigators. After being struck by Garcia’s vehicle on Interstate 15 McGrory was airlifted to St. Mary Medical Center in Apple Valley where he died from the injuries he sustained in the crash. A second California Highway Patrol officer was struck and killed Sunday in Paso Robles. The accident occurred at approximately 5:47 p.m. in the vicinity of River Road and Spanish Camp Road.

The officer was identified as California Highway Patrol officer Brett Oswald age 47.The California Highway Patrol officer had responded to an abandoned vehicle and was waiting for a tow truck. Officer Oswald was struck by a Toyota Corolla traveling at a high rate of speed around a curve and collided with the cruiser, according to CHP Officer Mike Muell.

During the collision Oswald was thrown in the air landing on the Toyota. Oswald was transported to Twin Cities Community Hospital in Templeton, where he died. The officer was pronounced dead at 8:30 a.m.

Police looking for Witnesses in Garden Grove Pedestrian Crash

June 22, 2010 (by Horatio Algren) According to reports police are searching for witnesses to a Garden Grove hit and run that injured a 76 year old man.

The accident according to Garden Grove police occurred at approximately 10:13 p.m. that involved a pedestrian and motor vehicle. The accident occurred in the vicinity of Chapman Avenue and Haster Street in the eastbound lanes.

The man that was found by police struck by a vehicle has been identified as Ricardo Colacion of Mexico, whose family was located and notified.

According to the Garden Grove Police, Colacion sustained serious injuries in the accident and was transported to UCI Medical Center and listed in critical, but stable condition.

Colacion was crossing Chapman Avenue according to police when 19 year old Angelica Gomez of Anaheim was driving east and saw Colacion, but was unable to avoid hitting him.

Police stated drugs or alcohol do not appear to have contributed to the accident.

Chapman Avenue was closed about three hours while police investigated the scene of the accident, which remains under investigation. Police are asking for witnesses with any information to contact them.

According to reports there have been no citations issued.

Workers Injured After Scaffold Collapses

June 15, 2010 (by Horatio Algren) According to reports three workers were injured Monday in the Glendale area after the scaffold they were on collapsed. The men according to reports were working on a scissor lift scaffold in the area near the Galleria in the vicinity of Broadway and Orange Street.

The collapse occurred at approximately 8:30 a.m. according to police the workers fell about 20 feet. The scaffold collapsed after becoming unstable while the three men were working on an external planter box.

The three men landed in the middle of Broadway after the collapse of the scissor lift scaffold according to Glendale Fire Department Capt. Vince Rifino. The three men were seriously injured and transported to USC Medical Center, with one of the men in critical condition according to Capt. Rifinio.

The men were not city workers, but were employed by the Galleria and an ongoing investigation into the accident is being conducted by the Occupational Safety and Health Administration.

According to Capt. Rifinio the scissor lift maximum stated two people at 500 pound maximum capacity. There were three men and they also had a can filled with rock and other debris on the scaffold.

The father of a six year old identified as Kayla Woods, who was killed when a car fleeing from police struck her stated he does not blame the police. Matt Woods stated that he doesn’t blame the police who were doing their job and that they cannot let everyone go.

The accident took place on Thursday evening in the vicinity of Birch Grove and Fenton Grove Lanes. When the vehicle the police were chasing turned onto a residential street where Kayla Woods, her four year old brother Aaron and two other children were playing in Lake View Terrace when she was struck.

According to police two of the suspects in the vehicle were arrested at the scene of the accident and the driver escaped on foot, but later was captured. The authorities believe the suspects to be tied to a narcotics case and threw two guns out of the car during the incident.

Kayla’s death is described by Los Angeles Police Chief Charlie Beck as “an extremely tragic incident” and the entire Los Angeles Police Department is grieving the six year olds death. Beck stated the blame for the child’s death falls on the suspects involved in the accident.

LAPD Cruisers Go Airborne and Cause Mid Air Landing

May 26, 2010 - to reports a crash involving two Los Angeles Police Department officers sends patrol car in mid air landing on parked vehicles.

The accident occurred at approximately 11:00 a.m. on May 21st in South Los Angeles at the intersection of Florence Avenue and Vermont Ave.

According to reports the patrol car was responding to a back-up call at the time of the accident with their lights and siren. The police vehicle was cut off by a red car at the intersection and the officer swerved to avoid a collision causing the police car to strike the curb.

Hitting the curb caused the vehicle to go air-bound, where it crashed through a brick wall and into an iron fence before landing on top of two parked cars.
The cars were parked in a shopping center parking lot and were empty at the time the police vehicle landed on them.

The officers have not been identified and were transported to an area hospital and said to have sustained minor injuries according to officials. The driver of the red vehicle has not been charged in the accident and the investigation is ongoing.

Child Struck While Crossing Street By Hit and Run Driver

According to Anaheim Police Sgt. Rick Martinez police were called at approximately 8:45 p.m. that a hit and run accident occurred involving the child. The accident according to Sgt. Martinez occurred in the 900 block of North Topeka Street and La Palma Avenue. The 4 year old boy and his 14 year old sister were crossing the street to their home when the accident happened.

The boy sustained abrasions to his face in the hit and run accident, he taken to the hospital and released. The children were playing with a group of friends and were going to cross the street with them to their home, when they saw a vehicle headed north on Topeka. The 14 year old girl and her brother crossed the street. The rest of the group of children waited to cross the street.

While running across the street, according to Sgt. Martinez the car identified as a dark colored sedan brushed the boy from the side. Sgt. Martinez stated the driver stopped and asked if the children were alright, and the 14 year old told the driver to pull over to the side of the street, the driver instead drove away.

The driver of the dark colored sedan has been described as having dark skin, with a beard and mustache. The driver according to the Anaheim Police could face misdemeanor hit and run charges.

Teen in Coma After Single Car Crash

May 10, 2010 9by Horatio Algren) According to reports a teen is reportedly in a coma after a single car crash over the weekend. The teen 16 year old was a passenger in a vehicle that crashed Saturday after the 20 year old driver lost control. The teen, according to reports, sustained head trauma and broken bones and is in a coma, according to Mission Hospital Pediatric ICU.

The single car accident took place according to Lake Forest Sheriff’s Sgt. Dan Walsh southbound on Saddleback Ranch Road, near Glenn Ranch Road when the vehicle a 2001 Toyota jumped the curb and struck a wall. The crash according to Sgt. Walsh occurred at approximately 3:30 a.m. the deputy also stated teen was wearing a seatbelt at the time of the crash.

The teen sustained multiple serious injuries, broken bones and is in a coma, the driver and two other passengers complained of back pain. Kuglin was transported to CHOC Children’s at Mission Hospital.

According to Lake Forests Sheriff’s Deputy Richard Nelson the police are investigating whether alcohol was a factor in the accident and the OCSD Major Accident Reconstruction Team is investigating the single car accident.

U.K. Personal Injury Attorneys to Face Closer Examination

April 22, 2010 (by Horatio Algren) Personal injury lawyers making more than £1 million per year on personal injury claims according to a new report should face closer examination.

According to Stormont’s Public Accounts some Northern Ireland personal injury attorneys should be scrutinized closer. It is believed that there is the potential for conflict of interest in a committee of judges and attorneys setting fees, which some stand to benefit financially.

During the year 2007-2008 there were payments made that involved tipping style accidents paid to plaintiffs’ attorneys equaling £1 million. The costs have increased almost four times with inflation over the past decade in claims against the Road Services.

Stormont’s Public Accounts chairman Paul Maskey stated the Committee believes that the legal profession is making these financial decisions to their benefit without considering the impact on the public and private sector which will bear the costs.

The tipping injuries on the roads and footpaths cost the Department for Regional Development £4 million between 2007 and 2008. According to Maskey approximately half of this money paid to claimants was paid for legal attorney’s legal fees and in house government advisers. The administrative costs are an additional £1 million a year.

Maskey believes this is a dangerous situation that does not meet the accepted principals of governance and accountability.

While the number of personal injury claims has decreased by half during the last ten years, the average cost of a successful injury claim has increased by approximately four times the rate of inflation. The reason for this is believed it is because the increases are outside of the Department’s control.

Compensation paid in Northern Ireland that is paid is almost twice the amount that is paid in England or Wales. One reason is due to the fact that juries made the decisions, while this was discontinued in England and Wales. England and Wales decisions are done by judicial guidelines, and with the change in Northern Ireland the differential was maintained. The difference between a severe ankle injury in Northern Ireland and England, would be the Irish claimant award starting at £18,000, while in England or Wales the same injury award would start at £7,625.

The Department pays for the compensation that is awarded in personal injury claims, for the claimants legal costs and for their own legal advice.

Ford Ranger Overturns After Anaheim Crash

April 19, 2010 (by Horatio Algren) According to reports a Ford Ranger overturned after a crash in Anaheim trapping the driver inside the pickup truck.

According to Anaheim Police Sgt. Rick Martinez the crash occurred in the vicinity of Rio Vista Street and Lincoln Avenue. The drive of the Ford Ranger was traveling southbound and in the middle of the intersection waiting to make a left turn when the accident happened.

The Ford was struck by a Dodge vehicle that was traveling eastbound on Lincoln Avenue, hitting the Ford Ranger in the side. The impact of the Dodge caused the pickup to overturn, trapping the driver inside of the vehicle for a short amount of time according to Sgt. Martinez.

The Anaheim Police officer stated that the driver of the Ford Ranger was able to get out of the pickup after firefighters broke the front windshield out of the vehicle. The driver appeared to be uninjured according to Sgt. Martinez.

The driver of the Dodge sustained injuries to his right hand and wrist, according to the police officer. Sgt. Martinez also stated there were no passengers in either of the vehicles and the rollover accident is still under investigation.

Family Sues City of Lynn for $35 Million for Lack of 13 year-olds Protection

March 22, 2010 (by Horatio Algren) According to reports the family of a 13 year old boy has brought a legal suit against the city of Lynn for not protecting the child. The family of 13 year old Matthew Mumbauer is suing the city of Lynn for $35 million claiming the child was not protected from a school bully.

Mumbauer states the bully allegedly pushed him down a staircase, which has left him in a wheelchair at Brickett Elementary School.

The attorney for the family sent a notice to eight city officials stating that the family claims administrators and teachers at the Brickett Elementary School ignored the bullying that then allegedly led up to Mumbauer being assaulted. The claim goes on to state that Mumbauer was left with a permanent spinal injury after allegedly being pushed down the staircase.

Doug Sheff, one of the attorneys for Mumbauer and his family stated he is hopeful some good will come out of this suit for others that are bullied and the schools will realize not only is it a moral obligation to stop this behavior, but also a financial one.

Sheff stated that the incident took place March 10, 2008 when Mumbauer was allegedly pushed down the school stairs and that there is also evidence the 13 year old complained prior to this incident. The evidence Sheff would not elaborate on he stated shows Mumbauer was bullied prior to the cervical spine injury that occurred March 10th.

City Solicitor Michael Barry stated that to prove their case the plaintiffs would have to prove that employees of the City of Lynn would have needed to have knowledge of the bullying prior to the incident. He also stated there is no school record of complaints by the child or family prior to the incident.

Barry stated there were no eyewitnesses to the incident to verify whether Mumbauer fell down the staircase or was pushed. He also said the 13 year old had two different accounts of the incident and who allegedly pushed him. The incident was not reported to police and contacted Alissa Cormier after learning about the incident through a fund raising fliers that were put up throughout the city March 31,2008.

Beacon Hill lawmakers have approved measures to handle bullying in schools, with required teacher training and requiring principals to report serious incidents to the police.

Multi-Million Dollar Settlement Approved in Lear Jet Crash

March 18, 2010 9by Horatio Algren) According to reports a judge approved a multi-million dollar settlement in a Lear jet crash.

Tuesday a judge approved more than $17 million dollar legal settlement over the life time of 3 year old Chris Bakers lifetime. This settlement was for a claim filed against Learjet Inc., Goodyear Tire & Rubber Co. and other companies involved in the operation and ownership of a jet that crashed killing former Blink 182 drummer Travis Barker’s assistant in 2008.

Federal investigators have not determined the cause of the airplane crash, but have stated the planes reverse were not in the right position.

The pilots were attempting to abort take off when the accident occurred in 2008 in Columbia South Carolina. There were four people killed in the crash including Baker, along with seriously injuring Barker and celebrity disc jockey DJ AM. DJ AM later died of a drug overdose and his case in the crash was settled for an undisclosed amount.

Bakers widow Otilia was also awarded over $7.6 million in the settlement ordered by Los Angeles Superior Court JudgeMary Strobel. Otilia Baker’s attorney Brian Panish stated that while this was a sad case his clients were glad that a trial was avoided and they received the full compensation.

Why You Need Patent Protection For Your Invention

A patent is one of the many forms of intellectual property (patents, trademarks, copyrights, trade secrets). Intellectual property or “IP” is about protecting “intangible” things, i.e. “intellectual” things or things of the mind. This is compared to “real” property which is about real estate. To break it down simply, patents protect inventions, like that new kitchen gadget, the novel online software, or unique medical device for example that an inventor has created. Trademarks protect the name or logo of the invention, typically for branding purposes, for example Nike is the trademark for their shoes. But Nike may have several patents that protect some of their novel shoe designs.

So why is getting a patent important? For several reasons. First, if you are a small inventor and you want to pitch your invention to companies, distributors, or investors. A primary concern is how you can protect the invention, and what will prevent others from stealing the idea. Protection of your invention boils down to two things, patent protection and/or a nondisclosure agreement (NDA). An NDA is a contract between the inventor and another party that forces the other party not to disclose to others what you are disclosing to them. But the problem with NDAs is that they are often ambiguous as to what is being disclosed and typically many companies will refuse to sign your NDA at all. Further, the NDA is only as good as the other person that signs it.

Patents in contrasts can be a much stronger right that allows the patent holder to sue infringers in court and to seek an injunction and damages, and in some cases of willfulness infringement, triple damages.

Further, an issued patent is a defined piece of property that you can sell in its entirety, or that you can license to allow other people the right to use what the patent is protecting. When you grant others a license you can receive patent royalties which can be very lucrative if negotiated properly. Another consideration is if you own a business that has issued patents and or other intellectual property like trademarks, it can greatly increase the value of the business if you ever intend to sell it or attract investors.

Other considerations, for marketing purposes having a “patented” product, or even a “patent pending” product adds so much credible to the company and the product or service itself in the mind of many consumers.

Lastly, you must have a patent in many cases if you want to sell you invention, particularly to larger companies. For example, many large companies have invention submission departments, but they will not even consider your idea and will actually return you idea to you if you do not have either an issued or pending patent. GM for example often will reject any new idea form outside the company if there is no patent in place.

Crib Recall After Hardware Fails

February 10, 2010 (by Horatio Algren) According to reports there is a recall in effect for two models of cribs after reported hardware failure. The cribs that are affected by the recall are two models that are sold in several stores including Buy Buy Baby, Wal-Mart, Kmart and other stores.

According to the Consumer Product Safety Commision the models involved are the Generation 2 Worldwide and ChildESIGNS, of which there have been more than 500,000 of the drop side cribs sold. They have stated that the plastic hardware is known to fail on the drop side and the mattress supports can break away from the crib frame.

These defects in the cribs can cause gaps where infants and toddlers can become trapped and suffocate or strangle.

So far the agency has received three reports, two of which the children involved died after becoming trapped in the gaps between the drop sides of the crib and their mattress.

One of the infant deaths occurred in July of 2007 when an 8 month old in Newark Ohio suffocated when the drop side of the crib detached, occurring from a broken stop tab on the lower track. The second suffocation death occurred when an 8 month old from Richmond Indiana died when the hardware broke allowing the drop side to detach from the crib’s headboard in one corner in October 2003.

The third infant that died was a 6 month old in Staunton Virginia in September of 2002, the death occurred due to two missing screws that allowed the lower drop side of the crib to pull away from the headboard post.

The company that manufactured the Generation 2 Worldwide crib went out of business in 2005 and according to the CPSC they believe that over 500,000 of the cribs were sold nationwide. These were sold at Wal-Mart, Kmart, Buy Buy Baby and other retail furniture stores.

There have been at least 20 reports of incidents that involved the drop sides and 8 reports of the mattress supports detaching to the CPSC. The ASTM International is responsible for setting voluntary industry safety standards for items such as steel used in commercial buildings and other things like children’s toys and cribs.

As of November 2009 there were new standards approved that will requires four removable sides for full size cribs. This along with their refusal to certify drop side cribs will help eliminate new manufacturing of the drop side cribs.

The CPSC stated owners of the cribs should contact the store where the crib was purchased for information about the recall, including refunds. They also stated any crib owner that has difficulties getting the crib fixed or a refund should contact their agency.

Huntington Beach Teen Awarded Settlement By the City

February 1, 2010 (by Horatio Algren) According to reports a 14 year old teenager was awarded a $30,000 settlement after breaking two bones in his right forearm.

The teen Douglas Young was awarded the settlement in Huntington Beach resulting from an accident two years ago when Young was a 12 year old riding a waveboard in a Huntington Beach alley.

Young’s attorney alleged the alley was in dangerous condition on May 10, 2008 when he was riding his waveboard near his home on Main Street. The bones according to an attorney, had to be manipulated back into place.

According to City Attorney Jennifer McGrath stated she was not going to risk going to trial after the judge had decided the waveboard was not inherently dangerous. This helped in making her decision to settle the case prior to going to jury trial next week.

Two Committees Schedule Hearings—Toyota Under Pressure

January 30, 2010 (by Horatio Algren) According to reports two congressional committees have scheduled hearings for the handling of the defects by the Toyota Motor Corp.

The recall of Toyota models included one on January 21, 2010, of 2.3 million U.S. vehicles due to a defect in the acceleration. The recall came after reports of unintended acceleration of some of the models, which added to the earlier recalls for the automaker.

The President of Akio Toyota made an apology for the recalls and mounting defects. The apology comes as the House Energy and Commerce Committee plans to hold a hearing February 25th to go over the report from the National Highway Traffic Safety Administration. Henry Waxman of California, the panel chairman stated on January 28th the Toyota vehicles have been linked with as many as 19 deaths.

The House Committee on Oversite and Government Reform is also planning to hold a hearing on February 10th. Waxman and Stupak, democrats stated in a letter to David Strickland head of the safety agency under Transportation Secretary Ray LaHood, they are requesting a report on every Toyota model that has received consumer complaints. The two democrats have also asked for the date the NHTSA was alerted to the defective accelerators and they also wrote the president of Toyota North America, Yoshimi Inaba.

Toyota has stated they will provide customers with details of how they will deal with the accelerator problems, and whether they will replace the accelerator assembly.

Caltrans Under Legal Fire By Injured Woman

January 26, 2010 (by Horatio Algren) According to reports by a Cal Trans injury lawyer, a woman has filed a legal suit against Caltrans and Monterey County for catastrophic injuries. The accident occurred on Highway 101 and San Juan Road in which a 92 year old woman was killed. The accident happened January 20, 2009 and the suit was filed by Anna Reznik.

Reznik age 66 stated in her suit against Caltrans and Monterey County that the state and county were negligent in maintaining public property. The accident occurred when Reznik was traveling south on Highway 101 and 69 year old Yon Ae Bowman pulled out in front of Reznik’s vehicle, while attempting to make a left turn.

According to Reznik’s attorney Boris Efron the accident broke most of the bones in Reznik’s feet and bones all the way to her pelvis, she also sustained massive head injuries. Her passenger 92 year old Olga Tarcher was killed in the accent and Resnik was bedridden for six months and remains in a wheelchair.

Reznik’s attorney stated that she is in need of round the clock care and is facing many more surgeries, she has also filed a claim against Bowman for her negligence in the accident at the Highway 101 San Juan intersection.

Morning Pileup Closes 101 Freeway

January 15, 2010 (by Horatio Algren) According to reports a three car collision closed the 101 Freeway during the Los Angeles morning commute in Encino.

The accident according to authorities occurred just after 6:00 a.m. on the 101 Freeway in the vicinity of White Oak Avenue. The three car pileup was in the westbound lanes backing up the commuted between San Fernando Valley and Los Angeles.

According to the California Highway Patrol firefighters on the scene had to extricate people from their vehicles, though they did not have information on the injuries that were caused by the accident.

The California Highway Patrol stated drivers should consider other routes and suggested Ventura Boulevard.

Driver in Fatal Farrari Crash Teen Driver

The driver of a gray 2008 F-430 Spider that crashed into a tow truck splitting it in two on December 24, 2009 was driven by 18 year old Luicci Nader of Huntington Beach according to authorities.

The accident that fatally injured passenger Ralph Abi age 24 occurred at approximately 5:12 p.m. on the East Coast Highway when Nader who was speeding lost control of the vehicle.

According to police Nader could be charged with manslaughter when he recovers from the crash that occurred when the sports car jumped the median in the vicinity of jamboree Road and Bayside Drive and striking the tow truck head on.

The driver and passenger in the tow truck sustained minor injuries in the crash and policed report that Nader was not driving under the influence at the time of the crash.

Women Killed By Hit and Run Driver

The woman identified as a 62 year old Annette Marie Carter was crossing Normandie Avenue, near South Adams Street and was reportedly not in a cross walk at the time of the accident. The accident according to Los Angeles Police Department detectives occurred at approximately 11:00 p.m. on Sunday.

According to detectives from, the Los Angeles Police Department’s South Traffic Division Lt. Brian Whitten stated the vehicle was dark colored and traveling north when it struck Carter and since the vehicle did not stop it becomes a crime. Whitten also stated that since Carter was not in a crosswalk it is possible if the vehicle stopped they would not have faced charges. The driver of the hit and run vehicle will now face felony hit and run according to Lt. Whitten.

According to authorities the vehicle that struck Carter is believed to be a Toyota Corolla or a similar vehicle and possibly has front end damage.

Fullerton Man Killed Santa Fe Springs

November 30, 2009 (by Horatio Algren) According to reports a Fullerton man was killed in an accident on the I-5 Freeway Friday.

According to the California Highway Patrol a man that has been identified as Keun Park was injured an accident that occurred on Friday November 13th at approximately 2:20 a.m. At the time of the crash Park was driving a 2000 Honda Accord in the southbound lanes of the I-5 Freeway, in the vicinity north of Boulevard.

Park turned left for unknown reasons, striking a metal divider, with the impact causing the Honda to go out of control into the lanes of traffic striking a 2008 GMC Yukon in the rear. The Honda then spun across the No. 1 lane where it was hit by a 1999 Acura Integra.

The collision between the Honda and the Acura caused major damage to the Honda and the impact caused the Acura to rollover coming to rest across the southbound No.2 and No. 3 lanes.

According to authorities the California Highway Patrol and the Los Angeles County Fire Department responded to the scene of the crash. There were two injured victims transported to the L.A. County USC Medical Center with moderate injuries.
Park was transported to the St. Francis Medical Center with major injuries and died two weeks later on Friday at the Kaiser Foundation Hospital in Anaheim at 9:25 a.m.

Largest Baby Crib Recall In U.S. History Set For Tuesday

Woman’s Family Blame Speeding Police Car For Traffic Related Death

November 20, 2009 (by Horatio Algren) According to reports the family of 25 year old Devin Petelski is blaming Los Angeles police officers for the woman’s death. Devin Petelski was involved in a traffic accident when she was entering a Venice intersection after stopping, at approximately midnight.

Petelski’s BMW was struck broadside by a Los Angeles Police Department cruiser that was reportedly responding to a burglary. According to reports the officers involved in the accident did not have their lights, flashing lights or siren on at the time of the collision.

The accident is still under investigation by the LAPD and according LAPD Det. Jesus Ravega the officers involved had not alerted the LAPD dispatchers that they were en route to the robbery. The detective also stated that the force of the collision spun the cruiser around and it then struck a tree and a traffic sign.

It has not yet been determined what speed the officers were traveling at the time of the accident, according to Ravega, but the posted speed limit is 40 miles per hour.
According to LAPD Cmdr. Stuart Maislin a new policy requires all officers to use their lights and sirens when traveling over the speed limit in response to a call.

Maclaren Recalling Baby Strollers After Amputations

Marine Fatally Injured In Camp Pendleton Collision

Orange County Trains Slow After Metrolink Train Hit Pickup

According to Angela Starr at approximately 6:45 a.m. a Metrolink train struck a stalled pickup truck in the vicinity of Norwalk.

A Chevy pickup truck was traveling northbound on Marquardt and making the left turn onto Rosecrans when it stalled on the tracks, said Starr. The driver exited the truck prior to the Metrolink train crashing into it and was uninjured.

The commuter train had left Oceanside at 5:20 a.m. and resumed its route approximately and hour and a half after the accident occurred.

Laguna Hills Crash Victim Identified

November 4, 2009 (by Horatio Algren) According to reports the identity of a woman killed in a Laguna Hills crash has been identified as a 60 year old San Diego resident.

According to coroner officials the woman that was fatally injured in a Sunday accident has been identified as 60 year old Louise Jordan of San Diego.

Orange County Sheriff’s investigators stated Jordan was riding in a Cadillac at the time of the crash when the vehicle she was riding, along with an unidentified 58 year old male driver was struck in the back, by a 27 year old male driver.

The accident occurred at approximately 4:40 p.m. on the Alicia Parkway, according to Lt. Ted Boyne of the Orange County Sheriff’s Office in the vicinity of Hon Avenue and Alicia Parkway intersection.

The 27 year old male was driving an Acura and had a 4 year old passenger, both who sustained minor injuries in the accident.

The 58 year old driver of the Cadillac sustained head injuries and was transported to Western Medical Center in Santa Ana.

According to Orange County investigators the accident is still under investigation.

According to Coast Guard spokeswoman Petty Officer Allyson Conroy, the collision occurred at approximately 7:10 about 50 miles off the coast of San Diego County and approximately 15 miles east of San Clemente Island.

According to Ian Gregor a spokesman for the Federal Aviation Administration, a pilot reported seeing a fireball in the vicinity of the collision. It was reported by the Coast Guard debris was spotted from the C-130 involved in the collision. The Coast Guard C-130 was reportedly carrying seven people onboard and according to Cpl Michael Stevens spokesman for Miramar Marine Corps Air Station the AH-1W Super Cobra involved in the collision had two people onboard.

Stevens also stated that the helicopter was on a training mission at the time of the collision and the crew are a part of the Marine Aircraft Group 39, based at Camp Pendleton 3rd marine Aircraft Wing.

According to Lt. Josh Nelson there were three cutters sent out, an MH-60 Jayhawk helicopter, and the Navy sent four vessels into the area and several helicopters in search of the nine missing people that were involved in the collision.

According to hospital officials at the Cedars-Sinai Medical Center an error was made when resetting a CT scanner, which was used as a new practice for a specialized type of scan in diagnosing stroke patients. The machine was reset to override the pre-programmed instructions to help doctors gain more useful data, with the scan. This would allow them to analyze disruptions in the blood flow to brain tissue.

In a statement the hospital officials have stated the CT machine resetting resulted in a higher than anticipated amount of radiation. According to reports the higher amount of radiation was eight times the amount that it should have been during the CT scans for stroke patients. The programming with a different protocol for the CT brain perfusion scan, subjected every patient that was given this tests an overdose of radiation.

The error was brought to the hospitals attention after a patient alerted them they had began losing hair after having the scan preformed. The mistake went unnoticed for 18 months and after a review of hospital records there have been 206 patients that could have been affected.

La Habra Police Officer Could Be Charged With Manslaughter in Deadly Chase

According to reports the California Highway Patrol is recommending that the Orange County Prosecutors Office file vehicular manslaughter charges against La Habra police officer Nancy Garcia in the April 5th accident that fatally injured Charles Antuna Sr. and his wife Susanne.

La Habra Police spokeswoman Cindy Knapp stated that an officer was on foot chasing a fugitive parolee and Garcia was responding to the call and was in the vicinity of La Habra Boulevard and Euclid Street. Garcia had her emergency lights and siren on when she went through a red light at approximately 62 mph.

Running the red light Garcia collided with Antuna’s car as Charles Antuna was driving east on La Habra Boulevard. The crash occurred at approximately 5:00 p.m., Suzanne Antuna was pronounced dead at the scene of the accident and Charles age 54 was transported to UC Irvine medical Center in Orange where he died early the next morning according to the La Habra Police Department spokeswoman.

Officer Garcia sustained minor injuries and was hospitalized overnight according to Knapp. She also went on to state that Garcia a two year veteran of the La Habra Police Department has been assigned not non-patrol duties.

California Highway Patrol supervised the investigation into the April 5th accident and released their report Monday that recommends the officer be charged in the deaths of the Antuna’s. The deadly crash occurred in San Diego County and is believed to have occurred after a floor mat was caught in the gas pedal on a Lexus.

According to the California Highway Patrol the accident took the lives of a family of four, one which was a 19 year veteran of the California Highway Patrol. Killed were Officer Mark Saylor age 45, his wife Cleofe age 45, Salylor’s brother-in-law Chris Lastrella age 38, and his daughter Mahala age 13.

The accident occurred on August 28 when the Lexus was traveling over 120 miles an hour and struck a sport utility vehicle causing it to be launched over an embankment rolling over several times and bursting into flames on impact.

According to reports Lastrella made a call to 911 seconds before the crash stating the vehicle had no breaks and the accelerator was stuck. The telephone call ended when someone in the background said to prey and a woman’s screams could be heard.
According to the National Highway Traffic Safety Investigators there was a rubber all weather floor mat found in the wreckage of the 2009 Lexus ES 350. Investigators stated was a floor mat from a different Lexus vehicle and that the ES 350 was a loaner vehicle from the dealer while their car was being repaired.

According to Toyota Motor Sales spokesperson for the Torrance based company stated that they planned to issue an order to approximately 1400 Toyota and Lexus dealers across the country to check each of their new, used and loaner vehicles have the proper floor mats and that they are properly secured in the vehicles.

Toyota has since recalled 55,000 floor mats in light of the National Highway Traffic Safety Administration and these included 30,500 mats from the Lexus ES350 and another 24,500 mats from the Toyota Camry.

Spokesperson for the National Highway Traffic Safety Administration Rae Tyson stated that they have also received complaints about the RAV 4 and the Tacoma.

Mays Autopsy Shows Heart Disease

Vernard Adams the Hillsborough County Medical Examiner has stated that while further tests are needed Billy Mays in his estimation died from a heart attack and suffered from hypertensive heart disease.

The medical examiner also stated Mays had been taking pain medication for hip pain, the prescription medication Tramadol and hydrocodone. Vernard also stated that there was no indication of abuse and the pill count matched what would have been the correct amount taken.

Vernard stated there was no head injuries found on Mays head from the rough landing on Saturday’s flight where he was struck on the head by falling items.

Mays was found early Sunday morning by his wife unresponsive according to police and he had told his wife the night before that he did not feel well and went to bed.

The 911 tapes have also been released, it was stated by his wife Deborah and another family member that he was unresponsive, cold to the touch, his lips were purple and he was not breathing.

Saturday Mays was also a passenger aboard a U.S. Airways plane that had a front tire under the nose blow out while landing at the Tampa International Airport. Mays was struck on the head by things falling from the ceiling.

According to the FAA spokesperson Laura Brown they do not know if Mays was wearing a seatbelt at the time the flight landed and added the FAA is not investigating Mays death.

Jim Olson spokesperson for U.S. Airways there was no reports of serious injuries from the passengers that were on the flight. Olson also stated that they plan to cooperate fully with any questions the local authorities have.
