State Fines Orange County Nursing Homes For Death Of Two Patients

June 11, 2009 (by Horatio Agern)

Fines have been levied against two nursing homes for inadequate care that led to the deaths of two patient deaths in Orange County. One death was due to dehydration, and in the other lack of CPR after a heart attack. The nursing home contends, they believed it was family wishes to not provide resuscitation in one case, the other involves the patient not getting ample fluids, which caused the patients death on Christmas day.

Alamitos West Health Care Center, in Los Alamitos was fined $100,000, and an $80,000 fine at the Huntingon Valley Healthcare Center in Huntington Beach. The California Department of Health found that at Alamitos West, the nursing home failed to provide an 82 year old woman sufficient fluids causing her to suffer dehydration and acute kidney failure. After the situation was attended to, it caused her death six days later. The woman first was admitted in November to the nursing home. Doctors ordered fluid intake and urine output to be observed and monitored 24 hours a day. Investigations revealed a registered dietitian at the nursing home had insufficient or improperly kept records to confirm that the patient was drinking enough fluids daily.

Betsy Hite, a spokeswoman at Alamitos West was interviewed and said the fine will be appealed. Declining to discuss the incident in detail, but said the nursing home was using this as an opportunity to look at systems and improve them if possible.

At Huntington Valley Healthcare Center, administrators told state officials that on March 2 a registered nurse supervisor did not call 911 as a patient was dying. Because she thought the patient had orders not to be resuscitated. The facts show the patient's medical records include a directive from family members which marked the option I do want CPR in an emergency situation.

Medical personnel at the time of the patient's death who were present were no longer employed by the nursing home when state officials investigated.

According to state officials, a nurse from the nursing home called to inform family members that the patient had died. According to the state's investigation, the nurse had told family members that patient was dead and that paramedics had not been contacted, because the facility had orders not to resuscitate the patient. The family replied by instructing the nurse to hang up and call 911. When the paramedics arrived the patient was in bed and had no heartbeat. No signs that CPR had been given were present, and a sheet covered the patient.

The administrator for Huntington Valley healthcare Center has not decided if the facility will appeal the fine.
