January 30, 2012 - According to reports a woman has filed a claim against the city of Huntington Beach after falling and being injured.
According to the lawsuit that is seeking $75,000 Rosa Herrera age 56 suffered injuries after falling on July 25th in Huntington Beach. The claim was filed January 23rd against Huntington Beach.
Herrera claims that she fell and tripped on a raised sidewalk, where tree roots had caused the sidewalk to become lifted on Flamingo Circle where she resides.
The suit claims in the fall Herrera injured her knees and right arm, fracturing her wrist that required two surgeries.
The claim includes that Herrera has current medical bills for approximately $61,000 and is asking for $14,000 in lost wages, since she has been unable to work since the fall and might ask for more according to the claim filed. Huntington Beach City officials said that the claim is being reviewed and if it is denied Herrera has the choice to drop the claim or to file a lawsuit.

Woman Struck in Crosswalk Near Elementary School Injured
January 13, 2012 (by Horatio Algren) According to reports a woman was injured when struck by a vehicle in a crosswalk near an elementary school.
According to Fullerton Police Lt. John Siko, the woman was struck in the crosswalk, at approximately 8:20 a.m. in the crosswalk at Richman Avenue and Baker Avenue in Fullerton. The crosswalk is located adjacent to the Woodcrest Elementary School, Lt. Siko said.
The woman was lying in the crosswalk in front of a Honda Civic, when officers arrived on the scene.
According to Lt. Siko the woman was transported to St. Jude Medical Center and the investigation is continuing into the accident to determine how it occurred.
Lt. Siko said did not know the details of the woman’s injuries.

Child Chokes to Death on Pushpin at School—Parents File Wrongful Death Lawsuit
January 6, 2012 - According to reports a wrongful death lawsuit has been filed by the parents of a child that choked to death on a pushpin at school.
According to Danny Howell a wrongful death lawsuit was filed on Thursday naming the North County Oceanside Montessori School in San Diego, in the choking death of 3 year old Tyler Howell.
The three year old was attending the school in October when he choked to death after swallowing a pushpin.
Danny Howell stated that the state discovered a variety of violations at the school, including allowing their son to use the bathroom alone. This is where three year old Tyler found the pushpin, according to family members. Another of the violations was allowing hazardous objects to be where a child could reach them, which is where the pushpin was located.
According to family attorney David Casey items like pushpins are required to be stored properly. Casey went on to state that objects that could cause death to a small child should not be around them.
Danny Howell stated that the violations are what led to the death of his son. The father stated that he, his wife and two and a half year old daughter are taking things one day at a time and that their daughter cries calling out Tyler’s name.
Howell said that he doesn’t know how something good can come from this tragedy, but if they can help other parents, sisters and brothers from going through this, their son’s death won’t be in vain.
Both attorney Casey and the Howell family are working on state legislation that would ban pushpins from both preschool and kindergarten classrooms. The Howell family said they would like to see warning labels on boxes of pushpins, to keep them out of the hands of small children.

Woman Crushed By Elevator at Cal State in Long Beach
December 7, 2011 - According to reports by the Long Beach elevator accident attorneys at Ehline Law firm PC, a woman was crushed to death by an elevator in Long Beach.
According to Long Beach Fire Department Captain Richard Brandt, the accident occurred prior to 9:00 a.m. at the Foundation Building at Cal State in Long Beach. Capt. Brandt said the elevator became stuck between floors on the third floor and the door was wedged open between the second and third floor. The woman attempted to escape, by crawling out of the elevator weighing 2,000 pounds, dropped on her as she was half way out of the elevator.
According to Capt. Brandt when an elevator becomes stuck it is crucial for people to stay inside of the elevator till rescue crews free them. First aide was administered to the woman, Capt. Brandt stated, but she was pronounced dead at the scene.
The woman was identified as Annette Lujan age 48 of Huntington Beach. According to Associate Vice President Toni Beron, stated there have been no problems with the elevator reported and they were inspected in April according to the Cal/OSHA regulations.

Hollywood Child Star Manager Arrested on Suspicion of Child Molestation
December 1, 2011 - According to reports a Hollywood child star manager has been arrested on suspicion of child molestation.
According to the Los Angeles Police Department at Topanga Division, Martin Weiss age 47 was arrested on Tuesday on suspicion of molesting one of his child star clients. According to Los Angeles Police Department coordinator for the sexual assault unit, Detective John Alviani, stated that Weiss was arrested on suspicion of committing lewd acts on a child under the age of 14, Tuesday.
Weiss was arrested in Santa Monica, where he lives and has is business, where detectives executed search warrants. According to the alleged victim, who was an aspiring musician and singer was allegedly sexually assaulted in Weiss’s apartment in Santa Monica and also in a Woodland Hills home.
Weiss was held at the Men’s Central Jail and Det. Alviani stated that police attempted to have the standard bail tripled due to the multiple counts in the alleged compliant.
Weiss’ bail was set at $300,000 by Superior Court Judge Melvin Sandvig. In court documents that were filed in Los Angeles the former client of Weiss went to police on November 17th to report the molestation that he suffered from the age of 11 or 12 years old, until he turned 15.
The victim now 18 stated that Weiss told him that what they were doing was common in the entertainment industry and if he told it would ruin his career and Weiss’. The alleged victim approached Weiss on November 15th at his Santa Monica apartment and taped the conversation. Weiss acknowledged the molestation, but stated that the victim showed interest in Weiss, which made it different than the sexual contact that the children at Penn State. Weiss stated that those children didn’t want to have sexual contact.
The victim went to police and told them that there had been other children raped that had spent the night at Weiss’ apartment and there could be other victims.
